These Terms govern your use of the Survey Ready 365 Mock Survey app (the "App") from G&G AI Group LLC, a North Carolina limited liability company (SOSID 3414669), 65 Boxer Run, Brevard, NC 28712 ("G&G", "we", "us"). By buying, unlocking or using the App you agree to these Terms and our Privacy Policy. If you use the App for a facility or company, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.

1. Eligibility and business use

The App is for business and professional use by people 18 or older. It is not a consumer product and is not for children.

2. What the App is

The App is a practice, self-assessment and education tool that helps skilled nursing facility staff prepare for a state survey. It organizes publicly available federal requirements and suggests work to do.

3. What the App is not

• Not legal, regulatory, clinical, medical or compliance advice. Consult qualified professionals (for example, an attorney, compliance officer or clinician) for those.
• No guarantee of survey results. A readiness score, list of F-tag gaps or AI paper check result does not predict or guarantee any survey outcome, deficiency citation, or the absence of one.
• Not affiliated with, endorsed by, or approved by the Centers for Medicare & Medicaid Services (CMS), the U.S. Department of Health and Human Services, the North Carolina Division of Health Service Regulation (NC DHSR), or any state survey agency. Surveyors make all actual findings.
• AI and keyword results can be wrong, incomplete or out of date. Review every result yourself before relying on it.

4. No PHI or personal information; your responsibility

• Upload policies and blank or de-identified forms only. You must not upload, photograph or enter protected health information (PHI) as defined under HIPAA, or other personal information about residents, patients, family members or staff (for example names, dates of birth, record or room numbers, Medicare or Medicaid numbers, photos of people, or signatures).
• Content is sent to a third party. Approved text is sent through our server to Cloudflare Workers AI for processing. See the Privacy Policy.
• Photos are not accepted for the AI check until on-device redaction of photos is available.
• Before your first AI check you must confirm that your papers contain no resident names or health information.
• Text redaction is an automated pattern check and can miss things. Review the redacted text before you tap Approve.
• No business associate relationship; no BAA. G&G is not your business associate under HIPAA, does not create, receive, maintain or transmit PHI on your behalf, and will not sign a Business Associate Agreement for the App. You are solely responsible for keeping PHI and personal information out of the App and for your facility's HIPAA and privacy compliance, including any breach assessment and notifications.

5. License

• When you buy, you get a limited, non-exclusive, non-transferable, revocable license to use the App for your organization's internal survey preparation, subject to these Terms.
• Each unlock code or license key works on up to 2 devices. Do not share, resell or publish codes. We may turn off codes that are shared, refunded, charged back or misused.
• The fictional demo can be used without a code. The AI paper check requires a valid code.
• We may update, change or stop features. Federal and state source materials change; we will try, but do not promise, to keep the App current.

6. Purchases and refunds

Purchases are made through Payhip, and payments are processed by Payhip's payment processors (such as Stripe or PayPal). Payhip does not issue refunds itself; refunds are handled by G&G. You may request a full refund within 14 days of purchase, no questions asked, by emailing support@ggaigroup.com with your order ID. When a purchase is refunded or charged back, its license is turned off. Prices are shown on the Payhip product page at checkout. Nothing in these Terms limits any refund right you have under applicable law.

7. Acceptable use

Do not: try to get around the license or device limit; overload or attack the service or the AI check; reverse engineer, scrape or resell the service; upload PHI or personal information; upload malicious code; or use the App for anything unlawful.

8. Intellectual property

The App's software, design and original text belong to G&G AI Group LLC. Federal regulations and CMS materials quoted in the App are public works of the U.S. government. Third-party open-source components are used under their licenses (for example, PDF.js under Apache-2.0). The AI model is provided by a third party through Cloudflare and is subject to its own license.

9. Disclaimer of warranties

TO THE FULLEST EXTENT ALLOWED BY LAW, THE APP AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT REDACTION WILL CATCH ALL SENSITIVE INFORMATION, OR THAT USING THE APP WILL RESULT IN ANY PARTICULAR SURVEY OUTCOME.

10. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) G&G AI GROUP LLC AND ITS MEMBERS, MANAGERS AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS OR REVENUE, LOSS OF DATA, OR FOR SURVEY DEFICIENCIES, CITATIONS, CIVIL MONEY PENALTIES, DENIAL OF PAYMENT, TERMINATION OF PROVIDER AGREEMENTS OR OTHER ENFORCEMENT ACTIONS, OR FOR ANY CLAIM ARISING FROM PHI OR PERSONAL INFORMATION YOU UPLOADED; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

11. Indemnity

You will defend, indemnify and hold harmless G&G AI Group LLC and its members, managers and contractors from any third-party claims, regulatory actions, losses, damages, fines and reasonable attorneys' fees arising from (a) content you upload, photograph or enter, including any PHI or personal information, (b) your violation of these Terms or applicable law (including HIPAA), or (c) your facility's survey preparation or compliance decisions.

12. Suspension and termination

We may suspend or end your access if you breach these Terms. Sections 3, 4, 8–14 survive.

13. Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state courts located in Transylvania County, North Carolina, or the U.S. District Court for the Western District of North Carolina, and you consent to those courts' jurisdiction.

14. Changes

We may update these Terms. We will change the "Last updated" date and, for material changes, post a notice in the App or on our website. Changes apply going forward; continued use after an update means you accept it.

15. General

These Terms and the Privacy Policy are the whole agreement about the App. If any part is unenforceable, the rest stays in effect. Failure to enforce a term is not a waiver. You may not assign these Terms without our consent.
